Rules of exchange
These Rules govern the provision of services by the exchange platform Cinus Exchange. Using the service and submitting an order means that the user accepts the terms of this document.
The Rules constitute a public offer. The agreement between the service and the user is deemed concluded once the client’s funds are actually credited to the service’s accounts under a created order.
The agreement term starts from the moment the order is submitted and continues until full performance of obligations by the parties or termination of the operation on the grounds provided for in these Rules.
The user confirms acceptance of the Rules within 24 hours from the moment the order is created. At the same time, the user accepts the service’s AML/KYC policy and agrees that identity and funds‑origin checks may be applied.
Under these Rules, Cinus Exchange acts as the Service Provider. A user who submits an order for exchange and uses the service is considered the Customer.
The Service Provider renders exchange services for a fee included in the terms of the relevant operation. Any difference resulting from the exchange and other profit provided for by the Rules constitute the Service Provider’s remuneration for the service.
Funds under a completed order are transferred only to the details specified by the Customer when creating the order. Payouts to accounts, cards, wallets or other payment instruments belonging to third parties are not allowed.
Use of third‑party details is prohibited both when paying for an order and when receiving funds under it. If the service determines that payment instruments not belonging to the Customer were used in the operation, it may suspend the order while clarifying the circumstances, cancel the exchange and block the user’s account.
The Customer confirms that all details indicated in the order belong to them on a lawful basis and are under their control. All consequences associated with using third‑party or incorrect details are borne by the Customer, including the risk of complete loss of funds.
An operation is considered completed after the Service Provider transfers the funds to the details specified by the Customer in the order.
The amount to be exchanged must be transferred strictly to the details specified by the service for payment of the order and within the time period allocated for such payment. Once the payment is made, the Customer must notify the service of the completed transfer, and in case of a fiat payment, provide a supporting receipt in PDF format.
If the user fails to transfer funds to the service’s details within the set period, sends them to other details, does not notify about the payment or does not provide a PDF receipt for a fiat operation, the Service Provider is not liable for the consequences of such actions.
When the amount actually received differs from the expected amount by no more than 10%, the service recalculates the operation based on the amount actually received, except for fiat transfers. If the discrepancy exceeds 10%, the Service Provider may refuse to perform the exchange and refund the funds to the Customer.
Payment details issued for order payment are valid only for the period specified in the order.
Unless otherwise indicated on the order page, the rate is fixed at the moment the order is created and remains valid until the end of the payment period. If the payment is received after this period expires, the exchange is recalculated at the rate effective at the moment the funds are actually received.
If the conditions of a particular order expressly provide that the rate is fixed after a certain number of network confirmations, then if the market rate changes by more than 0.1% by that moment, the order is recalculated at the current rate.
The required number of network confirmations is stated on the respective order page and on a separate information page of the service.
The standard processing time for an operation is up to 180 minutes from the moment full funds are credited to the Service Provider’s accounts. In some cases, completion of the exchange may take up to 3 business days.
If more than 72 hours have passed since the full receipt of funds and payout has not been fully completed, the Customer is entitled to request cancellation of the operation and a refund. This rule does not apply if the delay is caused by circumstances beyond the Service Provider’s control, other reasons not attributable to the service, or if payout has already been partially made.
The service does not accept funds sent via smart contracts and is not responsible for any resulting loss of such funds. To avoid blocks by banks, payment systems and other settlement participants, the Service Provider may also execute payout under a single order in several parts and from different accounts.
The Service Provider operates in accordance with AML/KYC principles and may, at any time, check the origin of funds used in an exchange operation.
At its discretion, the service may request that the client undergo identity verification, confirm rights to the payment instrument, including a bank card, or provide other information and documents required for checks. The reasons for such a request may not be disclosed.
If the user refuses to undergo verification or fails to provide the requested data, the Service Provider may suspend the operation, cancel it or apply other measures provided for by the AML/KYC policy.
The Customer confirms that they lawfully own the funds involved in the exchange.
The Service Provider may refuse to carry out an exchange operation without stating reasons.
The service is also entitled to freeze an order if attempts to interfere with its operation are detected, if the technical processing procedure is violated, or if suspicions arise regarding the security of the exchange.
Funds sent without creating an order and funds transferred to outdated, blocked or invalid details are non‑refundable. The Service Provider bears no responsibility for them.
The Service Provider is not liable for delays or other consequences resulting from circumstances beyond its control.
The service is not responsible for disruptions, errors or malfunctions of software, hardware, payment infrastructure, banks, networks or other external systems where such circumstances arise not through the fault of the Service Provider.
The Service Provider is not liable for unlawful actions of third parties or for consequences arising from incorrect details provided by the Customer when submitting an order.
The Customer is responsible for the completeness, accuracy and reliability of all information submitted when using the service.
The Service Provider is not liable for loss or other adverse consequences resulting from erroneous transfers of electronic currency if such consequences are associated with incorrect data provided by the Customer.
The AML/KYC policy of Cinus Exchange forms an integral part of these Rules and applies to all operations performed through the service.
In all matters related to identity checks, blocking of funds, refunds based on AML results and other control measures, the parties are guided by the provisions of the separate AML/KYC policy of the service.
